Doubt, you understand how it feels to be racially profiled

Stopped me by driving their SUV behind me through the grass and the sidewalk at mission beach. Typically they would not stop a white person walking down the sidewalk and this makes it racial profiling. The police then requested my ID without probable cause or sighting any little known laws that may have been broken by me by walking my little scooter, known as “Zuma” down the sidewalk with a helmet on. I was walking “Zuma” which is actually about 3 feet high and 4 feet long, smaller then a 26’ bike, that I rent from Craig down the sidewalk with my helmet on. Ironically, my helmet is painted with the American flag on it.

No other pedestrians were with in 300 yards at the time they stopped me and searched my things without any apparent reason other then my race. They said it was suspicious that I was walking my scooter down the sidewalk yet in reality they are simply harassing another innocent black man through stop and frisk style of policing. Though there any many people walking, riding scooters as well as bikes in this area. I explained that there is no where else to walk my scooter and told them it’d be unsafe for me to walk it on the street and it would be strange for me to walk it on the grass. I kindly asked where I would walk it and there was no reply. At the time of my arrested I was not sighted for any traffic violations or any crime. They discovered a warrant that was 9–18 months old out of San Jose that I knew nothing about. Though surprised, I gracefully put my hands behind my back and cooperated 100% with the arrest though I did not agree with it I knew I would be able

To bail out and found not guilty in due time.

My shoulders were stiff from the hand cuffs being pressed together aggressively in such a way where my shoulders and wrists were in pain. My wrist is cut vertically and horizontally spanning 7–9 inches. The way the hand cuffs were aggressively tightened onto my forearm instead of my wrist, I think Schindler and his coworkers were so excited about being able to arrest me that they added some extra attitude and pressure to hand cuffing me which was unnecessary. The way they grabbed my forearm, wrists and cuffed them also caused me pain to my shoulders which I told them several times. The scars from the hand cuffs are visible 12 days later.

Once at the station, I was left in the suv several minutes before being ushered into the station. All the while my shoulders were squeezed together from the way they arrested me. I told the officers about this and they did nothing, I told the medical person that my shoulders were in pain, they did not notate or treat me. They laughed about it and they told the medical personal not to write it or check up on my shoulders. On my wrists still is scars from where the hand cuffs had been made far too tight, drawing blood from my wrists and forearms. The medical, and the police ignored the blood and cuts on my arms.

Schindler, & his two coworkers were laughing at me during the arrest as they searched by belongings. He and his coworkers were antagonizing me by making jokes about me though I was being as graceful and professional as possible with each of them. They removed their body cam from themself while they were talking to each other. They placed the body cam inside the vehicle as they spoke to each other and went through my things. At the end of our interaction, as I sat waiting to be “processed” he was like “have fun in San Jose hahaha” insinuating that I would not bail out even though bail was an option and implying that I would have “fun” in San Jose jail. The joke to me was a bullying tactic that was completely unnecessary because I was already in hand cuffs, and at the station. It also seemed to be a prediction that I wouldn’t bail out though I made it clear to all of them that I would immediately post bail.

This type of sarcasm and verbal abuse is not appreciated considering the long history between the abuse of African Americans by law enforcement employees in America. I took the racial

Profiling and falsely issued warrant with grace yet they still had to go out of their way to throw salt in an old wound, considering the long history between the black males in America and the police, this type of behavior needs to be discouraged especially when a suspect is peaceful and 100% cooperative. The fact that I was fully compliant with what was being asked of me though I did not agree with it yet they still felt the need to be aggressive and antagonized me provides insight to their mentality against black men when policing. They still verbally abused me with their comments and use of a demeaning tonality as a sign of hate towards my race, completely unnecessary. I took this as my arrest alone was not enough, they also sought to verbally and psychologically abuse me.

I notate this as a method he and his coworkers use to escalate the situation unnecessarily in a verbally combative nature. His unprofessionalism is racially motivated behavior. I was professional, cooperative and truthful during our entire interaction. I felt that he was attempting to provoke me by laughing and making unnecessary remarks in attempt to insight anger or perhaps make me feel worse then I already did.

When I told the Police. and sheriffs that the person accusing me was a stripper they all laughed and one asked if she stripped at “the poodle” then they all erupted into laughter. I did not find this comment funny either because she did strip at the poodle and this is when I realized that it’s likely my accuser had made previous contact with sd police/sheriffs via the strip clubs.

I was asked to be finger printed again for my left hand, though I had been compliant and given both hand finger prints successfully already hours prior. At this point I began to feel targeted.

My bail was sabotaged the next day when bail agent from all pro bail bonds went to get my property, he said that the sdpd was quote

“dicking him around & would not release my property to them” even though I had signed a release form to them the day prior. In this way, the law enforcement employees have obstructed justice yet also have misrepresented sdpd and law enforcement as a whole by being unprofessional.

Once placed in a jail cell, I was going to make a phone call again for bail once placed in the jail yet my “pin” was not enrolled. I asked the officers on duty to assist me in enrolling my pin yet was not.

After multiple requests for three days to get my “pin enrolled to make phone calls” I then realized that I was intentionally prevented from making phone calls. Based on his comment, I was being prevented from being let out on bail unconstitutionally by each officer because they all work together and must have given illegal instructions to each other to not to provide me with a working “pin” to make calls in order to bail out . I was prevented from using my constitutional right to make phone calls for bail, in this way the police / sheriffs have obstructed justice.

A day or two after my release when I made it back to San Diego , 11 days later I went to the property space to get my iPad. I was informed that I would have to contact the arresting officer to get it back. Once I contacted a sergant because I didn’t want to contact the arresting officer directly, I was told that my ipad was booked as evidence and that I’d need to get permission from him or his sergeant directly to get it released. This is strange because only my iPad was booked as evidence yet my iPhone was not. All in all, I have notated that this law enforcement employee and his coworkers are racist at heart and is dangerous to the general public because of threir poor treatment of black men.

Once I spoke to the sergeant about my complaint, he ultimately tried to say that I was wrong and or suspicious for walking my scooter down the street and refused to acknowledge racial profiling as being the source of the stop. He was able to site 21663 which was never mentioned to me at the time of the stop, and also he was able to say that driving or moving a motorized vehicle would count as walking a mini-bike that is smaller then the average bike. He vaguely he admits that the police who stopped me has never actually issued this situation to anyone. After hours of research on the internet, I was also not able to find anyone who had even been stopped for walking a motorcycle yet alone a mini-bike on the sidewalk. It is arguable that there was no where else for me to walk my scooter as walking it on the street towards on coming traffic would surely be considered a safety hazard. The sergeant acted oblivious to racial profiling tactics as a whole and essentially attempted to discourage me from making the complaint. I overall took from the conversation that I was racially profiled because they don’t even write tickets for that and they essentially trapped me because there was no where else to actually walk my bike.

The sergeant said that it is up the the discretion, implying that they have an option to stop someone and or to write them a ticket. This is evidence that they do not stop people for this reason, and they also have not issued this ticket to anyone who is white. This is something that they stopped a black person for, have never stopped a white person for and have no record of ever siting a ticket. If they did site this as a ticket it would never stick because there is no where else to walk a bike or scooter that is safe. Essentially I was stopped for my race, but even if the stop was legit, it is more likely that the tracking device in the helmet and on the scooter is the way they located me. The tracking device being unconsented and the policing style being more of an ambush and hunt black people verses general public safety.

Typically this would not be an issue yet in combination with the aryan brotherhood gang affiliation of my accuser, her dad being a hit man murderer for the aryan brotherhood, my concern is that I am being targeted by white suprematism gang members who are with in and outside of police ranks, the accusations being said to have occurred on a day I was at work, there is more of a sense of targeting blacks people then there is of policing for the sake of enforcing laws.

This incident has costed me $4,000.00 and it has caused my wrist and arms a lot of pain. I was racially profiled, my things were illegally searched. Multiple unconsented GPS devices were used to track my movements. I was entrapped on the sidewalk by three San Diego police. I was prevented from making phone calls to post bail which is a violation of the constitution. My wrists and arm was scared from over aggressiveness from the San Diego police.
